Our Terms of Service and the Quagensia Desktop Application End-User License Agreement (EULA) have changed.
The new Terms of Service are effective immediately for new users and effective 30 days from May 6, 2024 for current users. The new Quagensia Desktop Application End-User License Agreement (EULA) will be included in one of the required steps of the installer of the next version of Quagensia N & T Edition.
Changes to our Terms of Service
The first point in the Terms of Service section titled “4. Additional Terms and Conditions for Quagensia Desktop Applications; End-User License Agreement (or ‘EULA’)”, item “i”, used to read as follows:
4. Additional Terms and Conditions for Quagensia Desktop Applications; End-User License Agreement (or “EULA”)
When you install an Edition of the Quagensia Desktop Application, such as Quagensia N Edition or Quagensia T Edition, you will be required to agree to an End-User License Agreement (or “EULA”) which may include additional terms. You will be bound by the EULA that you agree to. You agree that you will not install or use any Edition of the Quagensia Desktop Application until you have read and agreed to the aforementioned EULA. Without limiting the terms contained in the aforementioned EULA, you agree that you will not:
- Modify or create derivative works of the Software or any parts thereof with the exception that you may use the features built into the Software to copy or create a derivative work from any Quagensia Algo that comes included with the Quagensia Desktop Application when it is installed, so long as you view it, edit it, generate its code, or otherwise access it exclusively from within the Software, do not use it from within competing software, and do not do anything that is intended to hide or obscure the fact in the Quagensia Algos or in the code generated from them that the original Quagensia Algo you copied or from which you derived your Quagensia Algo originated from the Software;

- Do not violate the terms and conditions of the Software’s EULA regarding Quagensia Algos that are marked as being paid-only content exclusively for paid license holders described below;
- Do not violate any other terms or conditions of the Software’s EULA;

The first point in the EULA’s section titled “6. Restrictions on Use”, item “i”, used to read as follows:
6. Restrictions on Use
You agree that you will not:
- Modify or create derivative works of the Software or any parts thereof with the exception that you may use the features built into the Software to copy or create a derivative work from any Quagensia Algo that comes included with the Quagensia Desktop Application when it is installed, so long as you view it, edit it, generate its code, or otherwise access it exclusively from within the Software, do not use it from within competing software, and do not do anything that is intended to hide or obscure the fact in the Quagensia Algos or in the code generated from them that the original Quagensia Algo you copied or from which you derived your Quagensia Algo originated from the Software;
