FAQ: “Who owns the code generated by the Quagensia Desktop Application?”
You own your code in the same way that we own the code that we write. Namely, the code that we write includes copyrighted code from NinjaTrader, LLC, TradeStation Technologies, Inc., and Microsoft, Inc., that each company permits us and other users to use per their terms of service and/or end-user license agreements. The NinjaScript® strategy code and EasyLanguage® strategy code that Quagensia® N and T Edition users generate for the strategies they create with Quagensia N and T Edition also uses copyrighted code from these three companies as well as some of Quagensia, Inc.’s copyrighted code that we permit users to use per our Terms of Service located at https://www.quagensia.com/company/terms-of-service and per the Quagensia Desktop Application End-User License Agreement (EULA) that users agree to when they install Quagensia N or T Edition and whose current version is located at https://www.quagensia.com/company/quagensia-desktop-application-eula.
The implications of this for private traders, trading firms, and funds that use Quagensia N or T Edition to create strategies that they use privately for their own private trading are essentially non-existent.
If this is your use case, don’t worry about any of this. Also, just keep your strategies a secret from everybody, including EasyLanguage® and NinjaScript® programmers! Then nobody else knows your proprietary trading ideas and you can keep your edge from disappearing.
The implications of all of this for vendors in the trading industry is significant. For instance, while we allow many business models that use Quagensia N & T Editions, including selling Quagensia N & T Edition Strategy files (with file extensions of .qsnx and .qstx, i.e. the files you can open inside of Quagensia N or T Edition) outright, educators using Quagensia N & T Edition in courses, third-party Quagensia N & T Edition consultants and some other business models, our Terms of Service and Quagensia Desktop Application End-User License Agreement (EULA) that users agree to when they install Quagensia N or T Edition explicitly prohibit using Quagensia N or T Edition for the creation of black boxes and trading signal services and we state this prominently on the web pages where users download our software and view pricing information for Quagensia N and T Editions, and prominently in the product descriptions at the point of purchase (which is our FastSpring store).
